5.11 FROZEN WEPA!BOX Terms of Sale:

FROZEN WEPA!BOX edition (powered by WEPA!BOX), is a one-time seasonal box product for sale and it’s not part of the monthly or annual WEPA!BOX subscription plan. As part of this one time product sale, we will send you a box with a different selection of comestible products manufactured and/or made in Puerto Rico, which may consist of a selection of typical Christmas sweets, snacks (such as white chesse, “turrón” and “pasta de guayaba”), soup, “sofrito”, “longaniza” and “pasteles” among other Puerto Rican comestible products commonly offered on the island specially during the Christmas season (hereinafter collectively referred to as the “Products”). This list is not limitative of the Products that you will be receiving during this one-time sale, but it is included so that you as a user have an idea of ​​the type of Products you may be receiving as part of your one-time order of FROZEN WEPA!BOX. The Products you will receive are a surprise.  FROZEN WEPA!BOX will be available only for a limited time starting on November 26, 2018 through December 27, 2018. Any order must have to be placed during that limited time frame.

WHEN YOU REGISTER FOR A ONE-TIME ORDER OF FROZEN WEPA!BOX, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT WEPA!BOX (OR OUR EXTERNAL PAYMENT PROCESSOR) IS AUTHORIZED TO CHARGE YOU THE AMMOUNT OF $79.99 FOR ADDRESSES WITHIN PUERTO RICO, AND $149.99 FOR ANY ADDRESS WITHIN THE UNITED STATES MAINLAND, ALASKA & HAWAII, FOR YOUR ONE-TIME ORDER (IN ADDITION TO ANY APPLICABLE TAX AND OTHER CHARGES, INCLUDING DELIVERY).

Any claim related to the loss of a FROZEN WEPA!BOX already sent by us, must be made by you directly to the United States Postal Service, using the tracking number provided by  WEPA!BOX in the confirmation email you will receive when the Order of our Product is shipped. IT IS IMPORTANT THAT YOU PROVIDE YOUR CORRECT EMAIL ADDRESS AND FULL PHYSICAL DIRECTION FOR THE DELIVERY IN ACCORDANCE WITH THE USPS ACCEPTED GUIDELINESS. Please note that the accuracy of the address affects the speed and handling of your delivery. You will receive an email confirming the shipment of your FROZEN WEPA!BOX, which in turn will include the corresponding tracking number. If for any reason you do not receive this notification, you can request the tracking number of your Order at any time by sending us an email to [email protected] with your request.

ALL THE TERMS AND CONDITIONS DISCLOSED IN THIS WEBSITE, THE PRIVACY POLICY AND THE FREQUENTLY ASKED QUESTIONS REGARDING THE REGULAR (MONTHLY) BOX OF WEPA!BOX, COMPLEMENT AND EQUALLY APPLY TO THE FROZEN WEPA!BOX BOX IN EVERYTHING THAT IS NOT CONTRARY TO THE PROVISIONS HEREOF DISCLOSED FOR THIS SPECIAL SEASONAL BOX.

 

5.12 FROZEN WEPA!BOX Cancellation Policy:

FROZEN WEPA!BOX orders cannot be cancelled. You must review your order carefully before placing an order. Once the order for a FROZEN WEPA!BOX is confirmed and the one-time sale price is paid, WEPA!BOX will not refund the price of such order unless WEPA!BOX cancels or cannot fulfill your order, in which case, WEPA!BOX will provide a refund of all of the price of the order.

In the event that WEPA!BOX cancels or cannot fulfill your FROZEN WEPA!BOX order, please note that we can still send promotional communications about WEPA!BOX and/or FROZEN WEPA!BOX, unless you choose not to receive such communications by pressing the “Unsubscribe” button that will be available on all emails with promotional or advertising content that you receive from WEPA!BOX and that you follow the instructions provided through said link.

 

5.13 FROZEN WEPA!BOX Deliveries:

You are responsible for inspecting all Products you receive from us for any damage or other issues upon delivery.  In addition, you are solely responsible for determining the freshness of the Products you receive. You should always inspect your delivery to confirm that the ingredients arrive in a cool, refrigerated condition. In the unlikely event that you have any reason to believe that any Product in your delivery is not suitable for consumption, contact us at [email protected] (attaching photos of the item(s)) and discard the item(s). To maintain the quality and integrity of the Products, we recommend that you immediately refrigerate all perishable Products upon delivery and follow the U.S. Department of Agriculture’s (“USDA”) instructions on refrigeration and food safety, which can be found here: https://www.fsis.usda.gov/wps/portal/fsis/topics/food-safety-education/get-answers/food-safety-fact-sheets/safe-food-handling/refrigeration-and-food-safety/ct_index

From the time of delivery, the condition and consumption of the Products are solely at your risk, and you are solely responsible for the proper and safe washing, handling, preparation, storage, cooking, use and consumption of the Products following delivery. Failure to follow safe food handling practices and temperature recommendations may increase the risk of foodborne illness. If you are not at home when your delivery arrives, the courier will generally leave the package for you at your door.  Our Products are flash frozen at the peak of freshness and individually packaged and labeled. The Products are placed inside a reusable insulated shopping tote and tucked into a box that has an eco-friendly liner to keep the contents cold.  Your order will typically remain cold and fresh for several hours but depending on the season and temperature in your geographic area at the time of delivery, advance planning by you should be made for proper storage of your Products prior to consumption.  Any individual at the delivery address who accepts a delivery from us is presumed to be authorized to receive such delivery.  In cases in which you have designated an alternative receiver, such person shall accept the delivery under all of the same terms and conditions that would apply if you had accepted the delivery yourself.

In the case of inclement weather or other events beyond our control that interfere with our ability to deliver your Order, we will attempt to deliver your Order as soon as reasonably possible.  In the event of a carrier delay, please inspect the contents carefully and email [email protected] immediately with any concerns (attaching photos for review and including a detailed description of the issue).  In some cases, delivery may occur prior to the scheduled delivery date. In the event that timely delivery of your foodstuff is not feasible, we will cancel your delivery for the period so affected and issue you a credit or refund of the purchase price for that delivery.

 

5.14 FROZEN WEPA!BOX Returns and Refunds:

(a) FROZEN WEPA!BOX Standard Return / Refund Policy

(i)    We are shipping perishable products and therefore are not able to accept returns.  Unlike items that have a longer shelf life, items that are perishable cannot be restocked or resold.

(ii)    If you are not completely satisfied with your FROZEN WEPA!BOX Box for good reason, please contact [email protected] within seven (7) days of receipt. We will happily review your order and any reported issues and offer an appropriate resolution which may include replacement of the product in question, credit towards a next box, or a partial/full refund.  Since we are not able to physically access the product, we may ask that you provide photos of the product and a detailed damage report.

(iii)    We guarantee delivery to the address provided, and recognized as deliverable to by the United States Postal Service, when the order is placed/shipped and when retrieved on the guaranteed delivery date.

(iv)    Due to the perishable nature of our products, we cannot guarantee the condition of the delivery if the address is incorrectly entered, if a change of address isn’t updated prior to the invoice date, if an address is altered while in transit, or if you are unable to retrieve the order on the guaranteed delivery date and did not notify us prior to the order being invoiced.

(v)    When placing your order, please enter your shipping address carefully to ensure accuracy and review your receipt/account for any errors.  If you enter the shipping address incorrectly when the order is placed, please email [email protected] immediately for correction.

(vi)    If your order is returned to us because of an incorrect address provided or refusal of delivery when shipped according to our terms and conditions, we must dispose of the contents and you will not be refunded. In the event an order is delivered late due to an incorrect address or if you are unable to retrieve on the delivery date without prior notification and thawing/damage occurs, you will not be refunded.

 

(b) FROZEN WEPA!BOX Return / Refund Policy for Carrier-Damaged Products

(i)    We strive to provide a great selection of quality products delivered to your door and guarantee that your order will arrive in great condition when delivered to the address on file and retrieved on the guaranteed delivery date.

(ii)     While we would love every delivery to arrive on time and without issue, delays or damage can occur once the package is in transit via the carrier (USPS) that are out of our control due to weather, accidents, etc. In the event of damage caused by improper handling or late delivery, we are happy to file a claim and replace the shipment. We ask that you please email [email protected] within seven (7) days of receipt, provide a description of the damage, and a photo(s) of the order in the state it was received. Claim filing is time sensitive so photos and a detailed description of the damage are required in order to show proof of damage.

 

(c) FROZEN WEPA!BOX Return / Refund Policy for Damaged Products (not carrier related)

(i)     We strive to provide a great selection of quality products delivered to your door and guarantee that your order will arrive in great condition when delivered to the address on file and retrieved on the guaranteed delivery date.

(ii)    In the unlikely event of damage, we ask that you please email [email protected] within seven (7) days of receipt, provide a detailed description of the damage, and a photo(s) of the order in the state it was received. We will happily review your order and any reported issues and offer an appropriate resolution which may include replacement of the product in question, credit towards a next box, or a partial/full refund.  Since we aren’t able to physically access the product, we may ask that you provide photos of the product and a detailed damage report.
